1. General Information

www.mersinbilimmerkezi.com: A website (“Site”) presenting the corporate information of Mercan 100th Year Climate and Environment Science Center, owned by Mersin Metropolitan Municipality (“MBB”). Please read the conditions below. Accessing the Site is subject to the legal conditions outlined below between you and MBB.

2. General Terms of Use

From the moment you start using the Site, you gain the right to access, use, and benefit from this Site, any related sites, and the commercial communications, commercial electronic messages, specific interfaces, and functions offered through or via this Site.

• Accessing or using this Site means you have read and accepted the Camera Surveillance Disclosure Statement, KVKK Disclosure Statement, Personal Data Protection Law, Copyright, Cookie Policy, Usage Policy, and Conditions. No formal “acceptance statement” is required for this purpose.
• If membership or an explicit acceptance statement is required, you are deemed to have accepted the terms of use written here by selecting the “accept and approve” steps.
• If you believe you cannot fulfill the obligations outlined in the terms of use or meet the approval/permission conditions, do not use this Site. Additionally, if you are not of the required age for your acceptance statement to be valid or if you are under legal restrictions, your acceptance statement will not be legally valid, and you should not use this Site.

3. Monitoring/Modification of Terms of Use

To provide the best possible service to users (the term “User” refers to everyone accessing the Site, including members), the Site is continuously updated and renewed by MBB. Changes in the information and content offered may occur due to innovations and updates. MBB reserves the right to modify the terms of use or introduce new/additional conditions at any time without prior notice. Changes will be presented on the Site and will take effect on the date of publication. Use of the Site after such changes implies acceptance of those changes.

4. Membership Conditions

Registration: MBB may make the use of certain sections conditional on membership/registration, create different membership categories, or modify existing categories. Some identity and contact information may be requested during registration.

Username and Password: A username and password are provided to the member or created by the member. The member is responsible for all (i) identity information and (ii) contact information entered during registration, placed on the Site or its content, transmitted, or sent through this Site. It is assumed that the identity and contact information provided for registration is current, accurate, and reliable. The member is responsible for safeguarding the username and password. MBB assumes no responsibility for incorrect, unlawful, or unauthorized use of the username and password. In cases of unauthorized use, the member causing such use is responsible for any damages incurred by MBB or third parties. The member bears full responsibility for all actions performed through their membership account.

Members are deemed to have accepted and guaranteed that all information transmitted to or sent through the Site is reliable, accurate, non-misleading, does not infringe on third-party rights, is not unlawful, is provided in good faith, and that they have the right to post or transmit such information. The member is obliged to take necessary measures and notify MBB immediately upon learning of unauthorized use or attempts to access their username and password.

5. Use of the Site and Content

• Content on the Site, including logos, brands, promotional materials, data files, written texts, information, news, opinions, recommendations, advertisements, announcements, audio, music, videos, photos, visuals, software, and similar content (“Site Content”), may be provided and published partly by MBB and partly from other sources.
• MBB does not guarantee the accuracy or reliability of information, communications, commercial electronic messages, or other websites linked to or referenced, nor does it assume any legal responsibility. Users are responsible for complying with the usage and privacy policies and other notices of such third-party websites.
• Information and citations from third parties on the Site are for promotional purposes. MBB and/or the owners of this content reserve the right to change the content and terms of service without notice.
• There may be age-related legal restrictions regarding the Site. Users must comply with these restrictions.
• Unless otherwise specified by MBB, users do not have the right to sell products or services, engage in commercial advertising, announcements, or similar activities, or conduct trade using the Site’s pages or content.
• MBB has the right to determine the Site and its content as it sees fit and may present the Site with advertisements and promotions. Advertisements and promotions are not necessarily related to the Site. MBB may change the application and pricing of advertisements at any time and in any manner without prior notice.
• Users benefiting from the Site’s content are deemed to accept the risks associated with the content obtained through this Site.
• By accepting the terms of use and benefiting from the Site in any way, you accept responsibility for all actions you undertake. Users have the right to act or refrain from acting based on the Site’s content or communications conducted through the Site, regardless of the source. The legal consequences of such decisions are solely the user’s responsibility. MBB assumes no responsibility in this regard.
• MBB cannot be held responsible for any material, moral, legal, or financial consequences, damages, or indirect losses such as loss of profit arising from the use of content and services provided through the Site, including erroneous, unlawful, or illegal use. MBB does not guarantee the accuracy or adequacy of any opinions, information, evaluations, comments, or statistical data accessed through the Site. MBB is not responsible for errors or deficiencies in accessed sources, disruptions, delays, inaccuracies, or termination of data publication, or for direct and/or indirect damages, loss of profit, moral damages, or damages to third parties resulting from the use of accessed information. MBB may stop, cancel, modify, or remove such data flow without prior notice.

6. Personal Data

Personal data provided/recorded by users or collected automatically by the Site or through cookies in accordance with these Terms of Use will be subject to applicable law. This information may be used, processed, stored, and shared with third parties domestically or internationally for purposes such as providing access to the Site, member login, ensuring Site security, analyzing user habits, preferences, and likes, generating statistics, communication, marketing, announcements, or other purposes with the member’s explicit consent, in compliance with legislation and the Personal Data Policy. It may also be used within the scope of MBB’s activities for advertising, marketing, notifications, and similar activities. MBB reserves the right to use Site activity information, access tools, and browser information for these purposes. Users are prohibited from collecting, recording, processing, using, copying, or reproducing the personal data of other members/users or the Site’s database through the Site. Users can access detailed information about their rights regarding personal data and its processing in the Disclosure Statement and Personal Data Policy published on the Site.

7. User Content

• The user is solely responsible for all actions and transactions related to any information, written text, opinions, visuals, photos, links, and similar content (“User Content”) submitted or disclosed to the Site, including liability for compensating damages incurred by MBB and third parties. MBB reserves the right, without any obligation, to pre-screen, review, remove wholly or partially, or block access to User Content posted or sent by users to the Site.
• The user agrees and undertakes not to generate profit or engage in commercial activities through the User Content they add.
• Any User Content sent, transmitted, used, created, or sent to third parties through the Site by users is deemed to lose its confidentiality and not to include any intellectual or industrial property/copyright/license rights. When users create and add content to their accounts that is considered confidential or subject to intellectual and industrial property rights, it is assumed that such content does not contain “legal defects” and that they have the right to publish it through digital transmission. Otherwise, all responsibility lies with the user.
• The user accepts that User Content uploaded or shared in any way on the Site may be used by MBB and/or other users in a manner that includes promotional content, logos, or similar content determined by MBB, without any indication or reference to ownership or the discloser; may be shared with third parties or uploaded to other websites, linked, or viewed by third parties without membership requirements. MBB may commercialize User Content and generate income from it in any way. The user acknowledges and declares that they grant unconditional permission for MBB to use their User Content.

8. Sub and Parent Links

This Site may contain sub and parent sites not owned or controlled by MBB, operated by third parties, and may provide links or information about them. MBB does not guarantee or make any specific commitments regarding the content, suitability, security, privacy policies, or continuous availability of these accessed sites. MBB cannot be held responsible for personal data provided to these sites, the content and services used from these sites, or their privacy policies and practices.

9. No Warranty

This Site is provided to users as is, with the broadest extent permitted by law, without any written or verbal, specific or general warranty. MBB does not guarantee that the functions and content on this Site will be secure and error-free, that defects will be corrected, or that the Site, the server used to provide the Site, or third-party sub and parent sites/links are free from viruses or other harmful content. MBB does not provide any explicit or implicit commitment that the Site and its content will meet all expectations, purposes, or specific needs, or that it will be uninterrupted and of sufficient quality. MBB assumes no responsibility towards members or users for damages resulting from the Site or its content, including loss of profit, consequential damages, or indirect damages. MBB reserves the right to partially or completely terminate, close, modify, disable, or make the Site or its entire content, visual design, and similar elements paid without prior notice.

10. Violation of Terms of Use

In case of non-compliance with or attempts to violate the Website Terms of Use on the Site, whether the violation is fully realized or not, MBB reserves the right (though not obligated) to reject, remove, or delete existing information in the system, and to suspend, terminate, or cancel users’ access to the Site or their membership without prior notice. This also applies to indirect violations or attempts by a third party acting on behalf of the user. MBB’s failure to exercise or apply any legal right or measure specified herein does not mean that MBB waives its rights under these Terms of Use or applicable law or accepts the violation.

11. Commercial Communication

Members or users declare and accept that electronic messages or commercial electronic messages may be sent from websites not owned or controlled by MBB but operated by third parties, and they give prior permission/approval for the sending of any electronic communication, whether commercial or not. Members have the right to cancel this permission/approval at any time and reject commercial electronic messages. Rejection requests are processed by MBB within 3 business days at the latest. The methods for rejection are indicated in messages where MBB is the sender.

12. Collection of Visit Information

When the Site is visited, web servers automatically begin collecting information to facilitate communication with the visitor’s computer. Additionally, information such as the number of visits, which sections of the Site visitors prefer, IP addresses, domain types, browser types, dates, and times, as well as navigation on the website, is monitored, audited, and stored. Using the Site means the user grants MBB permission to collect, process, and store the specified information.

13. Prohibition of Interference

It is prohibited to violate or attempt to violate the Site’s security. Legal and criminal proceedings may be initiated, and lawsuits may be filed against those attempting such violations. Any claims of violation will be investigated by MBB, and if an illegal violation is suspected, relevant legal authorities will be contacted/cooperated with. If the actions specified in this clause are detected, the access of the relevant individuals and users to the Site will be terminated, and any memberships will be canceled. The person or persons committing the violation are financially, legally, and criminally liable to the person whose rights were violated and/or MBB under applicable laws.

14. Site Policies

• Criminal Acts: Users are obliged not to engage in any behavior that is i) considered a crime under international or local legislation or ii) contrary to the relevant regulations and directives of the European Union.
• Prohibited Behaviors: Users agree and undertake not to run or use software that sends more messages to the Site’s server in a given time period than a human’s sending capacity.

15. Language

In case of any discrepancy between the Turkish and foreign language versions of the website, “Terms of Use,” and “Privacy and Security Conditions,” the Turkish version shall be deemed valid.

16. Termination

Unless otherwise specified in a separate agreement or Site content, the user may terminate their use of the Site and any membership at any time without restrictions or notification. If specified on the Site, the steps for terminating membership must be followed. MBB may also, without any notification, cancel membership, restrict, or terminate use if: (i) the user violates the conditions or policies specified herein or determined by MBB, (ii) the user has no right to use due to legal restrictions, (iii) pursuant to legislation or decisions of administrative regulatory authorities, (iv) access to the Site is lost due to legal regulations or force majeure, or (v) at MBB’s discretion, the Site’s publication is suspended, stopped, terminated, or for similar reasons.

17. Records

In disputes arising from the use of the Site, MBB’s books, communication logs, all electronic and commercial records, and notifications sent to users via email or fax by MBB constitute definitive and exclusive evidence.

18. Notification Agreement

It is accepted that notifications sent by MBB to users’ contact information listed on the Site via email or fax will have the same legal effects as valid notifications.

19. Applicable Law

Disputes arising from the use of the Site shall be governed by the laws of the Republic of Turkey. Users residing outside the Republic of Turkey and accessing the Site from outside the Republic of Turkey also accept that the laws of the Republic of Turkey apply to disputes arising from the use of the Site and waive any rights arising from other applicable country regulations.

20. Competent Courts and Enforcement Offices

Mersin (Central) Courts and Enforcement Offices shall have jurisdiction over any disputes arising from the Site and its terms of use.
